WELL MR PRESIDENT IT IS WRONG FOR SOME AGRIC STAFF, FAO STAFF AND THE LIKES OF MOMODOU SABALLY TO BE DETAINED FOR MORE THAN 72 HOURS WITHOUT TRIAL The following have been under detention for more than 72 hours without appearing in court in gross violation of Section 19 of the Constitution: Momodou Sabally, former Secretary General and Minister of Presidential Affairs, Foday Jadama Regional Director, Kutubo Sanyang, Project Coordinator Cowpea, Mr Kebba Drammeh, Senior Agricultural Officer at the Wellingara Model Centre, Musa Dampha , Commications Education Extention Services, Fafanding Fatajo, the Project Coordinator of FASDEP, Lamin Fatajo, the Project Coordinator of Rural Finance, Dr Saikou E. Sanyang, the Regional Director of Agriculture NBR, Dr Sanyang, the Regional Director of Agriculture CRR, Mr Cherno Mballow of Agric Business, Mr Mbemba Dahaba, Lieutenant Colonel Solo Bojang, former Commander of the State Guards in Kanilai and manager of the Kanilai Family Farms (KFF), Commissioner of the Gambia Prison, Mr Thomas Jarju andex- Protocol Officer at the state house, Mr Momodou Sowe. Allow us to repeat, like a broken record, that Section 19 Subsection (1) of the Constitution states without ambiguity that, “(1) Every person shall have the right to liberty and security of person. No one shall be subjected to arbitrary arrest or detention. No one shall be deprived of his or her liberty except on such grounds and in accordance with such procedures as are established by law. Subsection 3 (b) adds that, “Any person who is arrested or detained upon reasonable suspicion of his or her having committed, or being about to commit, a criminal offence under the Laws of The Gambia, and who is not released, shall be brought without undue delay before a court and, in any event, within seventy-two hours. The constitution is clear. The following should not be detained for more than 72 hours without appearing in court: Momodou Sabally, , Solo Bojang, Momodou Sowe, Thomas Jarju, Foday Jadama, Kutubo Sanyang, Mr Kebba Drammeh, Musa Dampha, Fafanding Fatajo, Lamin Fatajo, Dr Saikou E. Sanyang, Dr Sanyang, Mr Cherno Mballow and Mr Mbemba Dahaba. ]]>
